MyPond Terms of Service

These terms are an agreement between you and Natural Waterscapes LLC ("Natural Waterscapes", "we", "us") for the use of MyPond, the pond and lake management platform at mypond.naturalwaterscapes.com, including its public pages, the email program and the connector for AI assistants (together, "MyPond").

By creating a MyPond account, or by continuing to use MyPond after the effective date above, you agree to these terms and to our Privacy Policy, which explains how we handle your information and is part of this agreement. If you do not agree, please do not use MyPond.

1. Who can use MyPond

You must be at least 18 years old and able to enter a binding contract. MyPond is designed for ponds in the United States and is offered to people in the United States. If you use MyPond on behalf of a business, an association or another person, you confirm that you have authority to agree to these terms for them, and "you" includes them.

2. Your account

• Sign-in is provided through our sign-in provider. Keep your credentials private. You are responsible for everything done through your account until you tell us it has been compromised.
• Give us accurate information and keep it current. We may send account and service messages, such as a pond being assigned to you, to the email address on your account.
• One person, one account. Do not create accounts for others without their permission, and do not use an address on the naturalwaterscapes.com domain unless you are authorized to.
• Natural Waterscapes may create a pond record for a property it has surveyed or mapped and assign it to the owner's account, or make it available to claim. Claiming a pond you do not own or manage is a breach of these terms.

3. What MyPond is, and is not

MyPond turns your traced shoreline, depth readings, water quality entries and public mapping data into a site profile, a measured volume, watershed and soil analysis, water quality ratings, treatment quantities and equipment sizing. Everything it produces depends on the accuracy of what you enter and on public datasets we do not control.

We may add, change, limit or remove features at any time, including free features, and we may set limits such as the number of ponds an account can hold. Where a change removes something you paid for, section 7 applies.

4. Your content and our license to it

You own the information you enter into MyPond: pond outlines, readings, treatments, notes, photos and everything else ("your content"). You are responsible for having the right to enter it, including for any photo you upload and any pond you trace.

So that we can operate and improve MyPond, you grant Natural Waterscapes a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, transmit and analyze your content for the purposes described in the Privacy Policy, including to provide the service to you and to anyone you share a pond with, to recommend products and services suited to your pond, and to respond when you ask us for help.

You also agree that we may create de-identified and aggregated data from your content and from your use of MyPond, as described in section 5 of the Privacy Policy, and that we may use, publish, share and license that de-identified data for any purpose, including research, benchmarks, product development, and partnerships with research, university, extension and industry organizations. De-identified data does not identify you or the specific location of your property, we will not attempt to re-identify it, and this license is perpetual and survives the closing of your account.

Work product that Natural Waterscapes creates, such as a pond record it mapped, a field evaluation it performed, or a report its staff wrote, belongs to Natural Waterscapes, and we may keep it, with your personal information removed, after your account closes.

5. Sharing ponds with others

• You can share a pond with other people by email or by invite link and set what they can do. An invite link works for whoever holds it until it expires or you revoke it, so treat it like a key.
• You are responsible for what the people you share with can see, including the pond's location and photos. Revoke access when it is no longer needed.
• If you accept a share, you agree to use the pond's data only as the person who shared it intends.
• Public links such as a shared fishing forecast show only what the page says they show. Anyone with the link can view it.

6. Acceptable use

Do not:

• enter a pond, claim a pond, or upload content you have no right to;
• enter false readings or treatments intended to mislead someone you share with, or to manipulate recommendations or benchmarks;
• use MyPond to collect information about other people or properties, or to scrape, crawl or bulk-export data other than your own through the tools we provide;
• probe, overload, reverse engineer or interfere with MyPond, its security, or the services it relies on, or bypass a limit, a rate limit or an access control;
• resell MyPond, offer it as your own service, or use it to build a competing dataset, without a written agreement with us;
• use MyPond in a way that breaks the law or these terms.

7. MyPond Plus subscriptions

• MyPond Plus is a paid subscription with the limits and features described on the pricing page at the time you buy it. Prices are in U.S. dollars and exclude applicable sales tax, which is calculated at checkout.
• Subscriptions renew automatically, monthly or yearly per your selection, until canceled. You authorize our payment processor to charge the payment method on file at each renewal.
• Cancel anytime from Profile, Manage Subscription. Your plan stays active through the end of the paid period. We do not prorate or refund a partial period unless the law requires it or we say so in writing.
• If a payment fails, we will retry and notify you. If it keeps failing, your account returns to the free plan after a grace period, and ponds above the free limit are locked until you choose which to keep, remove ponds, or resubscribe. We do not delete your data because a payment failed.
• We may change prices with at least 30 days' notice by email. A price change takes effect at your next renewal after the notice period.
• If we discontinue a paid feature during a period you have paid for, we will refund the unused portion of that period or offer an equivalent replacement.

8. Products and services from Natural Waterscapes

MyPond may recommend Natural Waterscapes products and let you buy them, request a printed catalog, request help, or arrange a water test or a site visit. Purchases are governed by the terms of the Natural Waterscapes shop and any written quote or agreement for services. A recommendation is an estimate under section 3, not a guarantee that a product will solve a problem.

9. AI assistants and the MyPond connector

• You may connect MyPond to a third-party AI assistant. The assistant can read, but not change, the ponds your account can access, as described in the Privacy Policy.
• The assistant, and what it says about your data, is that provider's product and is governed by its terms. We are not responsible for an assistant's interpretation of MyPond data, and an assistant's answer is not advice from Natural Waterscapes.
• The public connector tools answer general questions from our published knowledge and show a demo pond. They may be used only in the way the assistant platforms allow, and not to bulk-extract MyPond's content.
• You can disconnect at any time in the assistant's settings, and we may suspend a connection that is abusive or insecure.

10. Our intellectual property

MyPond, including its software, design, methods, text, images, knowledge base and the MyPond and Natural Waterscapes names and logos, belongs to Natural Waterscapes or its licensors and is protected by copyright, trademark and other laws. These terms give you a personal, non-exclusive, non-transferable, revocable right to use MyPond as intended. Nothing here transfers any ownership to you. Public datasets shown in MyPond remain subject to their own licenses and attributions.

If you send us feedback or suggestions, we may use them without any obligation to you.

11. Disclaimers

MyPond is provided "as is" and "as available". To the fullest extent the law allows, Natural Waterscapes disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that MyPond will be uninterrupted, error-free or secure, that any estimate will be accurate, that a treatment will work, or that a pond will hold water, support fish, or behave as MyPond predicts. Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent the law allows, Natural Waterscapes and its owners, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of fish, crops, livestock, water, use, profits, data or goodwill, arising out of or related to MyPond or these terms, however caused and under any theory of liability, even if we were told such damages were possible.

Our total liability for all claims arising out of or related to MyPond or these terms will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us for MyPond in the twelve months before the claim arose. This limit does not apply to liability that cannot be limited by law. Some states do not allow certain limitations, so parts of this section may not apply to you.

13. Your responsibility for your use

You agree to defend, indemnify and hold harmless Natural Waterscapes and its owners, employees and contractors from any claim, loss or expense, including reasonable attorneys' fees, arising from your content, your use of MyPond, your application of any product or treatment, your sharing of a pond with others, or your breach of these terms or the law.

14. Ending the agreement

• You can stop using MyPond at any time and ask us to delete your account by emailing support@naturalwaterscapes.com from the address on your account. The Privacy Policy explains what is deleted and what is kept.
• We may suspend or close your account, or limit features, if you breach these terms, if your use creates risk or legal exposure for us or others, if an account is inactive for an extended period, or if we discontinue MyPond. Where reasonable, we will notify you and give you a chance to export your data.
• Sections 4 (license and de-identified data), 10 through 13, 15 and 17 survive the end of this agreement.

15. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Lycoming County, Pennsylvania, and you consent to their jurisdiction. Before filing, you agree to contact us at the address below and give us 30 days to try to resolve the matter. Nothing in this section prevents either of us from seeking an injunction to protect intellectual property or from bringing a claim in small claims court.

16. Changes to these terms

We may update these terms. We will post the new version here with a new effective date and, for material changes, notify you by email or in the app before they take effect. Continuing to use MyPond after the effective date means you accept the new terms. If you do not, stop using MyPond and ask us to close your account.

17. General

• These terms and the Privacy Policy are the whole agreement between you and Natural Waterscapes about MyPond and replace any earlier understanding.
• If a court finds part of these terms unenforceable, the rest stays in effect.
• If we do not enforce a term right away, we can still enforce it later.
• You may not transfer this agreement. We may transfer it as part of a merger, sale or reorganization.
• We are not responsible for delays or failures caused by events outside our reasonable control, including outages of the third-party services MyPond relies on.
