MyPond Privacy Policy

MyPond is a pond and lake management platform operated by Natural Waterscapes LLC ("Natural Waterscapes", "we", "us"). This policy explains what information MyPond collects, how we use it, who we share it with, how long we keep it, and the choices you have.

By creating a MyPond account, or by continuing to use MyPond after the effective date above, you agree to this policy and to our Terms of Service. If you do not agree, please do not use MyPond.

1. Who this policy covers

This policy covers the MyPond web application at mypond.naturalwaterscapes.com, its public pages, the MyPond email program, and the MyPond connector for AI assistants.

Your MyPond sign-in is shared with other Natural Waterscapes applications on naturalwaterscapes.com, such as Fish Tracker. The sign-in itself is covered here; each application describes what it does with your data on its own pages. The Natural Waterscapes online shop and the naturalwaterscapes.com website are separate services. When you buy from the shop through MyPond, the order is covered by this policy and by the shop's own terms.

2. Information we collect

2.1 Information you give us

• Account information. Your email address and display name, provided through our sign-in provider. Optionally, a mailing address and phone number on your profile.
• Pond information. The name and address of each pond, its exact location and traced shoreline, depth readings (including your device's GPS position and accuracy when you record depths in the field), and the pond profile you fill in: aeration and other equipment, how the pond is used, water sources, fish species stocked, known problems, and any notes you write.
• Records. Water quality readings, including the sample location, method, lab name and notes; treatments applied, including product, method and your rating of the result; troubleshooting answers; and photos with their descriptions.
• Photos. Photos you upload are stored as you send them. If your camera embedded location, date or device information in the file, that information is stored with the photo and is visible to anyone the photo is shared with.
• Requests and messages. Anything you send through the Request Help form, the feedback form, live chat, the pond claim page or the printed catalog request, including your name, contact details, shipping address and message.
• Sharing. The email addresses of people you invite to a pond.
• Purchases. If you subscribe to MyPond Plus or buy from the Natural Waterscapes shop through MyPond, we receive your order details and shipping and billing addresses. Card and bank details go directly to our payment processors and are never stored by MyPond.

2.2 Information we derive about your pond

When you trace a pond, MyPond sends its location and outline to public and commercial mapping services to build the pond's site profile: soil types and properties from the USDA Natural Resources Conservation Service, bedrock geology, elevation, streams and watershed boundaries from the U.S. Geological Survey, land cover, terrain and watershed analysis and satellite imagery from our mapping platform provider, and weather from a weather data provider. The resulting profile is stored with your pond. Your pond's location is the only personal information involved in these requests; your name and email are not sent.

2.3 Information collected automatically

• Usage. Which parts of MyPond you use, which tools you open and which steps you complete, recorded against your account so we can see how features are used and improve them.
• Security and provenance logs. Actions taken in your account, when, and from which IP address, kept as a record of who changed what.
• AI assistant access. When an AI assistant reads your pond data through the MyPond connector, we log your account, the tool called, the pond involved, whether the call succeeded, the assistant's identifying string and the IP address the request came from. See section 7.
• Email activity. Whether emails we send are delivered, opened or bounced, as reported to us by our email delivery provider.
• Technical data. Browser type, device, pages visited and referring page, collected by the analytics and advertising tools described in section 9.
• Pond claim and access requests. When you search for a pond to claim or ask for access to a pond, we keep the search terms, your email and a hashed form of your IP address to detect abuse.

3. How we use information

We use the information above to:

• provide MyPond: build and display your pond profile, size treatments and equipment to your measured pond, track water quality and treatment history, and generate reports;
• run your account: sign you in, manage sharing and permissions, process subscriptions and orders, and send account and service messages such as pond assignments and share invitations;
• send reminders, alerts and suggestions you have not turned off: treatment follow-ups, water quality alerts, seasonal reminders, fishing forecasts, feature updates and tips (section 10 explains how to turn each off);
• recommend products and services suited to your pond, including Natural Waterscapes products, based on your pond's measurements, water quality and history;
• respond when you ask for help, which may include Natural Waterscapes staff reviewing your pond's data and contacting you;
• improve MyPond: understand how features are used, fix problems, and refine our sizing, dosing and recommendation methods;
• keep MyPond secure: detect abuse, enforce limits, and keep a record of changes;
• measure and run our marketing, as described in section 9;
• comply with law and enforce our Terms of Service.

4. Natural Waterscapes staff access

Natural Waterscapes staff can view any pond in MyPond, including its location, records and photos, in order to provide the service, respond to requests, map and assign ponds, and support customers. Staff access is logged.

5. Your pond data and how we may use it

You own the information you enter into MyPond. So that we can operate and improve the service, you grant Natural Waterscapes a worldwide, non-exclusive, royalty-free license to store, process, display and analyze your pond data for the purposes described in section 3.

We may also create de-identified and aggregated data from information in MyPond: for example, regional water quality benchmarks, treatment outcome statistics, or counts of ponds by county. De-identified data does not identify you or the specific location of your property. We may use de-identified and aggregated data for any purpose, including research, publications, product development, training and calibrating our own analytical models, marketing analysis, and sharing or licensing it to research, university, extension and industry partners.

We commit that we will not attempt to re-identify de-identified data, that we maintain technical measures to keep it de-identified, and that any third party who receives it is contractually bound to the same commitments. This license to de-identified and aggregated data is perpetual and survives the deletion of your account.

We do not sell your personal information for money.

6. Who we share information with

We share personal information with the companies that provide parts of MyPond on our behalf, under contracts that limit what they may do with it:

We also share information:

• with people you share a pond with, who can see the pond's records at the level of access you grant. Viewers cannot see lab names you entered, your mailing address or your phone number.
• with AI assistants you connect (section 7).
• with Natural Waterscapes as the operator of MyPond, for the purposes in section 3, including offering you Natural Waterscapes products and services.
• when required by law, to respond to legal process, or to protect the rights, safety or property of Natural Waterscapes, our users or others.
• in a business transfer, if Natural Waterscapes or MyPond is sold or merged, in which case this policy continues to apply to your information.

7. AI assistants and the MyPond connector

You can connect MyPond to an AI assistant such as Claude or ChatGPT. When you do:

• You authorize the connection through our sign-in provider, which asks for your email, your profile and permission to keep the connection active. The assistant receives your email address and name from that authorization.
• The assistant can read, but never change, the ponds your account has access to: pond names, dimensions and volumes, the site profile (soils, geology, watershed), water quality readings, treatment history, and the results of MyPond's analysis tools. The connector does not return your pond's address or coordinates. Species lookups are scoped to the pond's county.
• Everything the assistant reads becomes subject to that assistant provider's own privacy terms, which you accepted when you connected it. We do not control what the assistant does with the data.
• We log each call the assistant makes: your account, the tool used, the pond involved, whether it succeeded, the assistant's identifying string, and the IP address the request came from. These logs are kept for 24 months as a security record.
• You can disconnect at any time by removing MyPond from the assistant's connector settings.

The public tools of the connector, which answer general pond questions and show a demo pond, do not require an account and do not access anyone's pond data.

8. How long we keep information

When you delete your account (section 10), we delete your account information, contact details, photos, usage events and other personal fields within 30 days, except where we must keep records for legal, billing or security reasons. Pond records that Natural Waterscapes created and mapped, and ponds shared with other users, may be retained with your personal information removed. De-identified and aggregated data is retained under section 5.

9. Cookies, analytics and advertising

MyPond itself sets no cookies. Our sign-in provider sets cookies on naturalwaterscapes.com to keep you signed in across Natural Waterscapes applications. MyPond stores preferences such as your last-viewed pond and display settings in your browser's local storage.

We use third-party tools that set their own cookies and collect device and usage information on our public pages and inside the app:

• Google Analytics and Google Ads. We use Google Analytics to measure how MyPond is used and to measure sign-ups and purchases, and Google Ads conversion tracking and remarketing to measure and improve our advertising. Google's use of this data is described at policies.google.com/technologies/partner-sites. You can opt out of Google Analytics with the browser add-on at tools.google.com/dlpage/gaoptout and manage ad personalization at adssettings.google.com.
• Meta Pixel. We use the Meta Pixel to measure the results of our advertising on Facebook and Instagram, including sign-ups and purchases, and to reach people with similar interests. You can manage how Meta uses this data in your Meta ad settings. In some states this measurement counts as "sharing" personal information for targeted advertising; you can opt out as described in section 10.
• Zoho PageSense and Zoho SalesIQ for page analytics and live chat. If you start a chat from within MyPond, the name, email and phone number on your profile are passed to the chat so our team can respond.
• Opinly for website and search analytics.

You can block cookies in your browser settings. MyPond will still work, but you will need to sign in more often.

10. Your choices and rights

• Email. Every reminder, alert, suggestion and announcement can be turned off individually in Communication Preferences on your profile, or with the unsubscribe link in the email. Account and service messages, such as a pond being assigned to you, cannot be turned off while you have an account.
• Sharing. You control who can see each pond and at what level, and can revoke access at any time.
• AI assistants. Disconnect at any time in the assistant's settings.
• Access, correction, export and deletion. You can view and edit most of your information in MyPond. To request a copy of your information, correct something you cannot edit, or delete your account, email support@naturalwaterscapes.com from the email address on your account. We will verify the request and respond within 30 days. We will not treat you differently for exercising these rights.
• Targeted advertising opt-out. To opt out of the advertising measurement described in section 9, email support@naturalwaterscapes.com or use the browser and platform controls described there.
• State privacy rights. Residents of California and certain other states may have additional rights, including the right to know what personal information we hold, to have it deleted, to opt out of the sale or sharing of personal information, and to appeal a decision. We extend these rights to all MyPond users through the contact above. We do not sell personal information, and we do not knowingly collect the personal information of anyone under 16.

11. Outside the United States

MyPond is designed for ponds in the United States and is offered to people in the United States. Our data sources, prices and services are United States based, and we do not direct MyPond to people in other countries. If you use MyPond from outside the United States, you do so on your own initiative: your information will be transferred to, stored and processed in the United States, where privacy laws may differ from those where you live, and by using MyPond you consent to that transfer. You may exercise the choices in section 10 wherever you live. If you would rather we did not hold your information, you can ask us to delete your account at any time.

12. Children

MyPond is intended for adults 18 and over and is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.

13. Security

MyPond runs on a global cloud network with encryption in transit. Sign-in and payments are handled by specialist providers; we never see or store your password or card number. Pond sharing and staff access are logged. No system is perfectly secure, and you are responsible for keeping your sign-in credentials private and for the access you grant to others.

14. Changes to this policy

We will post any changes here and update the date at the top. If a change materially expands how we use your personal information, we will notify you by email or in the app before it takes effect and, where required, ask for your agreement again.
